Social Sciences Collaborative Research Projects : lauréat 2010-2012

Bonjour, je vous indique que je suis lauréat de la bourse de recherche du programme Social Sciences Collaborative Research Projects mis en place entre les ambassades de France et d'Australie. Avec le professeur Paul Latimer de l'Université de Monash, nous avons décidé de mener un projet de recherche (du moins, les premières pierres) en droit des sociétés et des marchés financiers pour voir de quelle manières les instruments juridiques appréhendent la RSE.

Résumé du projet : Concerns about corporate social responsibility (CSR) and stakeholder theory have grown significantly during the last two decades. The CSR debate is evidently intertwined with the debate on the proper objectives of the corporation and especially with the traditional and well-known problem of the relationships between the interests of stockholders on one hand, and the interests of other stakeholders on the other. The main goal of this research is to show how corporate law and corporate governance in France and Australia reflects the veracity of CSR and stakeholder theory. It is widely observed that companies in Australia and in France are increasingly responding to pressures to recognise their obligations to stakeholders other than simply their shareholders. Precisely how, and the extent to which, they have responded, however, remains unclear. This research proposes to demonstrate the assimilation of these theories into the corpus of corporate and financial law mechanisms. The outcomes are several orders. First of all, a publication of a working paper or in a French or English journal is envisaged. Then, this research will be an opportunity to invite one of the researchers for organizing an international seminary of research allowing in order to build a long-term collaboration.
